Looks like Media Borough may be taken back to court over "Anxious" and "Immediate" attempt to rezone.

Media Borough Council may again be in the hot seat over a quickly scheduled zoning meeting that happened last Friday at 8am.  Not only was the notice of the meeting advertised on page 37 of the Daily Times a mere day before the meeting, the group the zoning was to effect wasn't even contacted.

Broomall Lake Country Club has sent a letter to Media Borough objecting to the proposed MERC rezoning of their property.  Citing in paragraph two:

"The Borough's anxious and immediate attempt to re-zone Broomall's Lake Country Club is suspect considering the multiple past issues between the parties, including the issues with the Damn Bridge, etc.  An attempt to spot zone it's property to diminish it's value and to convert it to public use would be in violation of its Constitutional Rights under both the Federal and State constitution."

  1. Only elected officials drunk on power would do something like this. Media sure does have a bad situation on it's hands.

  2. Great next time their is a disput over illegal residential bldg going on in the borough of media now we know what lawyer to call
Unbelieve Media Borogh should have someone dismissed from your job over this reckless attempt at spot Zoming embrassing for all of Media Borough to have games go on like this. Congratulations Mr Bonner !

  3. How long do the Media Borough polical underlings
Need to lie and deceive residents because of political favours and games being played between
    BLCC and Media Borough
Doesn't seem to make legal sense to give a organization 30 hour notice on Zoming changes. Same is true of residential construction- no letters alerting residents to commencement of work are ever mailed and work routinely begins without building permits displayed

The Borough of Media has a real problem following their own rules and seem to selectively enforce rules

Just curious the flag at borough hall was at full staff today at 5:30 pm

  6. I must be missing something. BLCC is zoned residential? It's been around for 100 years and it's zoned residential? WTH. Were BLCC members told that their owners want to develop the property? Did they have a say in that?

    1. Broomalls files as a tax exempt non profit. 501 (c) (7) recreational. Let that sink in.

    2. All country clubs are 501(c)(7)s. That doesn't mean they don't have the right to own or sell property or deserve to be needlessly harassed by politicians embarrassed by their repeatedly failed attempts to cause damage to what they perceive as a political enemy. But the fact that you are smart enough to know what a 501(c)(7) is means that you already know this. No one here is that stupid to think a 501(c)(7) can't own or sell property in furtherance of its tax exempt purpose. Why is the Media Borough so obsessed with Broomall's Lake? (because they lost) Why didn't they fix the bridge when they had the funds? (because they liked having their little closed off area to walk their dogs) It's really sad that this is how they treat the entity that preserved this land for around one hundred years if that is accurate. Do you think Media Borough would have done that or would one of the politicians over those one hundred years sold the property to a political friend to develop?

  7. Could someone tell me if Rumsey and Lasrshorn are Boro residents?
They are pushing this change. There are even Middletown residents going on social media and pushing for this change too, they should stick to their illegal and unenforceable "LOCAL TRAFFIC ONLY"signs.
I don't want to see anything else built on that property but this zoning change is over the top even for this uber liberal who hates Trump.

  9. Given all the variances given to the west end flats it would be competely reasonable
To allow BLCC to remain R2 plus there is already a precident set with the townhomes that are already "existing" Media borough knows the "Exisiting" game all to well when they approve projects.

    1. Wrong given that the club wants special tax status filing as a 501 (c) (7) recreational. The IRS should look into the board of Directors.

    2. That's not how it works. Tax exempts can buy and sell property. This is a silly point you keep trying to make.

    3. EXISTING is not wrong it's correct
The IRS could look into a lot of people
Including all nonprofits not just BLCC
Media Borough effectively has a nonprofit charitable giving program with all the variances handed out for West End Flats and ignoring setbacks certainly this wasn't done for free

    4. Anon 6;12pm. You seem upset about the club's tax status. as mentioned above non profits are allowed to own and sell property.

Social clubs are exempt from federal income tax under IRC 501(a) as organizations described in IRC 501(c)(7) if they are "organized for pleasure, recreation, and other nonprofitable purposes." They were originally granted exemption from federal income tax in the Revenue Act of 1916.

It seems the club pays local real estate taxes. What the heck would the IRS "look into the board of Directors" as you put it for? Are you simply advocating for more harassment towards the club because you don't agree with what the club can lawfully do with its land? If so may I suggest you start a "Go Fund Me" or some other way to raise money buy the club and then do with it whatever you'd like to (within the law). Otherwise respect property owners have a right to do or develop whatever they choose within the law. Media could very well be setting the residents up for another lengthy and costly lawsuit with this seemingly attempt at "spot zoning"

    5. Maybe we should Spot zone the open lot in Oakmont Townhomes from R3 to to MERC if the borough doesn't already own it ?

    6. Also please spot zone the tennis courts on the Strine Property after all it was a tennis court so it should be MERC as well

    7. How about the IRS look into that non profit ---- The Media Five Miler......just saying.....

    8. Right seems like their were no filings for M5 mile even though they clearly take in more then the IRS threshold amount after paying Run the Day organization for race timing

  10. Has anyone pressed any of the current Media council candidates on their feelings about this issue? I'd be interested if the Johnson twins are pro spot zoning, and has anyone told Sayre Dixon that a federal lawsuit would cost tons of $$$ to defend? If anyone on here has had any of those conversations, please do share!

    1. I would say that media borough council probably didn't even read the letter sent by Mr. Bonner esquire
If they did none of them would know how to respond - they can't even run a highway and streets dept without money and resources being wasted. Glad to see our 100 k generator being exercised though
Thanks Higgins Electric it might be the only successful project in the last couple of years

  11. Yep they live on 4th St. and enjoy parking their cars on BLCC's property. Terry and Robin have high standards and principles just don't threaten the free parking they use on the Club's property if so they may start a new facebook page to Keep Media Green (and save their parking). How do you spell self serving hypocrites?

    1. Is there a no parking sign there?
If this is private property BLCC
Would have the right to post a no parking sign would they not ?

    2. Anon 12:24pm Classic the George Costanza excuse...

George Costanza: [pause] Was that wrong? Should I not have done that? I tell you, I gotta plead ignorance on this thing, because if anyone had said anything to me at all when I first started here that that sort of thing is frowned upon...

Most adults know what is and is not their property. Regardless of the Club having or not having a NO PARKING SIGN Terry and Robin KNOW where they currently park their car is NOT THEIR PROPERTY.

  17. I am a member of BLCC and I certainly would not like to see townhomes go up on the property. I am irritated that they are putting forth that this letter represents the membership. I am all for the restriction of development of this property. The wooded areas are part of what makes the swim club unique. There are certainly other ways for BLCC to cover its shortfalls. The pool is never full and most days it's empty. Expanding membership, even doubling it, would not make much of a difference to the amount of people at the pool on any given day and would certainly cover any current shortfalls.
