Media Borough Council found in Contempt of Court. Community Embarrassed

The recent ruling by Judge Proud has found Media Borough Council in contempt of court over Third Street Bridge.  Media resident, Michael Jordan writes letter to the editor expressing embarrassment over the matter.

Media's lack of leadership and political agendas by local officials continues to make the news while taking a toll on the integrity of the borough.  As things are going now, the Wawa project will also most likely be handled the same way - decided by a judge.

  1. Well well well--- now that Media has been found in Contempt of Court the "shield" of being an elected official is no longer valid. I hope the County and Broomall's Lake sue the members of Boro Council AS INDIVIDUALS and hit them in the same pockets Boro Council has been hitting the tax payers in to keep this charade going. Lets see what the Council Members say now that their money is on the line.

    1. Wow can they really sue the Council members? That would be awesome how much do you think the County and BLCC could get? hopefully enough to cover the new bridge and dam maintenance. Classic

      Does that theory also apply to jail time ? All the Council members will be at our monthly meeting tomorrow night. The Sheriff could just drop in at 8:00 PM.

    5. How can the Borough appeal? What else is left to decide? The Pa. State Court sent this back to Judge Proud to decide if the Borough appeals they (The Pa. State Court Justices) will most likely affirm judge Proud's ruling. Which means more $$$$ blown by Media's Council members on a SPECIAL INTEREST ISSUE that is a joke.

      I personally hope ALL Council members get fined and or go to jail over being held in Contempt of Court

      But most people found in contempt of court either go to jail or pay fines and i still believe they can also be sued. Please explain how you think it works.

  4. Michael is 100% correct. These people are an embarrassment. As the county seat of Delaware Co. we should expect more of this municipality, not less. We are consistently hit with the 'less'. And yes, I will personally make a call to Mary McFall Hopper and ensure that some law enforcement representation will be present at tomorrow night's council meeting, and they should take each one of them to the George Hill correctional facility. Media taxpayers are now on the hook for all expenses and legal fees incurred by BLCC, and as a taxpayer I am fuming. ENOUGH ALREADY! Our elected officials are no longer operating in the best interest of the borough and SHOULD be fined, incarcerated, impeached and more.
    How do we form a committee to get this going? Tedman, any ideas?

  5. Anyone else find it interesting that the "OTHER" Media news site Media Pa News written i believe by Council Person Kent Davidson has not even mentioned or reported Judge Proud's ruling on the 3 rd Street issue. Nothing reported as if nothing happened. Talk about having your head in the sand.

    1. Surprised, nah. Council will never acknowledge or admit wrongdoing. Their 30 day window is fast approaching to make some sort of movement towards their 'due diligence'. BLCC I hope you're watching!
      Oh and BTW, another $15K spent tonight by the intrepid council to buy a trailer to store the event barricades. Are you f'in kidding? Lets all move to Middletown where people actually know how to run a municipality.

  9. First off I will say that anyone who is willing to put themselves out there and run for a post and get elected by a community has my respect. Even someone like Councilman Davidson who I disagree with on many issues is a person who I can at least say appears to be up to the task of sitting on council. If you have the guts and will sacrifice your own time that is commendable in my opinion. With that being said I watched the Media Council meeting last night and if anyone can tell me that the best candidates were elected on their merits and not just because they are Democrats I think you are kidding yourself. If a man like Dr. Lemon can get raked over the coals for being some kind of wolf in sheep's clothing, as he was portrayed, and not even get a sniff at being elected and yet a few of the members I heard last night managed to get the votes something is wrong. The people get the government they deserve and I think some bad choices have been made all in the name of voting for Democrats based on party only.
    I am really wondering what the next step in the vilification of the 3rd Street Dam/Bride is going to be since I do not think the "do -gooders" are finished holding everything up. Let me say it again that the road was needed a long time ago and is needed more now. Media is the County seat and should have as much access as possible especially since this is not a new road but rather one that has been shut down due to incompetence over a period of almost 2 decades. A few of the leaders of the FROG group are absolute frauds and it is not the love of nature but their own arrogance that drives them. They think they are better than the people on Orange and feel they are on some high moral ground because they don't live in the new development on Kirk. What they are is a group that wants to either have no bridge or have a gate that is controlled by what they see as fit. What a bunch of BS.

    2. The "high hazard dam" as you put it will provide safe transportation in and out of Media the county seat. The way it has for over 100 years. The only reason the dam is considered " high hazard" is due to the width. It has NOTHING to do with the structure integrity of the dam. Please stop trying to mislead the public with your sad attempt at hysteria over the "high hazard" dam. Ribbit ribbit

    3. Characterizing the Stipulation that has now been upheld as a taxpayer giveaway to BLCC is misleading. Under the Stipulation, Media Borough is responsible only for maintenance of roadway while County and BLCC split maintenance of structure. As I have written before, there would be no reason for BLCC to contribute to a bridge which would cost the taxpayers more if designed for auto traffic. Keeping the dam (which is the support for the road) gave BLCC a reason to allocate money towards dam maintenance when in the past Media Borough had maintained the dam. The Stipulation also ended the underlying lawsuit. BLCC could have adopted the same strategy as the Borough and hoped that the lawsuit would release them from financial responsibility for dam maintenance. Maybe a court would determine the Media Borough avoid any financial responsibility for the situation, but maybe not. There was a real possibility that the Borough could have incurred far greater liability. I'm not sure that "bet it all" on winning a lawsuit is a sound policy decision. In many ways the Stipulation was the cheapest was to rebuild a useful roadway. To me, using tax dollars to build a pedestrian roadway or bike path as many wanted seems to benefit fewer people.

      I am interested in what comes next. Maybe make nice with the County. With both entities currently rehabilitating their own parking lots (the jury lot and Olive St. lots, maybe there are possibilities to collectively work on some improvements to the parking situation.

      Please read the response given by Dave Daniel above for my thoughts on your question.
      I also agree that using scare tactics is a good portion of your argument. You do know that it is only considered High Hazard due to it's height and width. I would think that if a design that has outlived it's usefulness and a structure that has been in constant decay for over 20 years can still hold back the "shrinking" lake a nice and shinny new dam will do just fine for another 100 years.
      I am in the camp that will thank the club once the roadway is in place. It is a road that is needed by a fair portion of the population and requested by The Police and Fire Department. So the fact that the good people who own the club will allow a dam is a great way to save a lot of money. I would be in favor of the road even at 8 times the cost if bridge were to go back instead but considering that we don't have that type of funding the dam is the most economical way to accomplish the goal . The County Seat and all of the shops that need business certainly justify more ways into town, especially considering it was needed all those years ago when first built. Orange Street is a mess due to extra traffic and should be considered when the selfish members of FROGS act like their part of town trumps all. Maybe you should take a few clipboards down to Orange and ask if they mind taking all of the traffic and if they agree that people on 3rd and PEL deserve to have a private part of town. Almost two decades of getting extra traffic so others can have none is not very neighborly. Forcing school buses to burn more fuel is not environmentally friendly. Commandeering funds that are for a road and trying to reallocate them for a hippie rope bridge is not a smart use of public money.
      I hear that Park's Edge Lane is having a lot of issues with the original work that was done on those beautiful houses that ruin the view from the park. I hope that is not the case but if shoddy work was done in the actual construction I wonder what type of site evaluation was done and if any consideration was given to the affect of the homes and paved surfaces would have on the sanctuary that it jams up against? Did the super stewards of the planet consider that when purchasing the home? I am sure that they did so hopefully that is not an issue we will be hearing about years down the road.
      I guess we will all find out soon enough if this fight continues or if the work , the jobs and the access that the dam provides will move forward. At this point who the heck knows and based on what I saw of the new council I would not be surprised about anything that gets pulled.

  12. Tedman, your blog keeps us all informed. Thank you. One request, can you find out what the legal fees of the borough's special council (3rd Street Bridge) cost the taxpayers? I know when Dawn Roe was on council she was keeping a running tab. If you find anything, post it on your blog.
